A BILL to amend and reenact §30-3-7a of the Code of West Virginia,
1931, as amended, relating to the practice of radiologic
assistants and radiologic practitioner assistants who are
regulated by the Board of Medicine.
Be it enacted by the Legislature of West Virginia:
That §30-3-7a of the Code of West Virginia, 1931, as amended,
be amended and reenacted, to read as follows:
ARTICLE 3. WEST VIRGINIA MEDICAL PRACTICE ACT.
§30-3-7a. Findings and Rule-making authority.
(a) The Legislature finds that it is appropriate and in the
public interest to require the board of Medicine to regulate the
practice of Radiologist Assistants.
(b) The West Virginia Board of Medicine, with the advice of
the West Virginia Medical Imaging and Radiation Therapy Technology
Board of Examiners, shall propose rules for legislative approval, in accordance with the provisions of article three, chapter twenty-
nine-a of this code, to:
(1) Establish the scope of practice of a Radiologist
Assistant;
(2) Develop the education and training requirements for a
Radiologist Assistant: Provided, That
"the certification
examination given by the American Registry of Radiologic
Technologists(ARRT) and the certification examination given by the
Certification Board for Radiology Practitioner Assistants
(CRBRPA)shall be acceptable qualifying examinations for licensure
as a radiologic assistant";
and
(3) Regulate Radiologist Assistants: Provided, That the
supervising physician may be a Board Certified Radiologist or a
Board eligible Radiologist.
